IMPORTANT: READ CAREFULLY - THIS AGREEMENT IS LEGALLY BINDING
This agreement shall be binding on YES! Marketing Pty Limited (ABN 71 062 310 927) (herein referred to as "YES! Marketing") and the other entity with whom this agreement is made (herein referred to as "the User").

Interpretation
Headings are included in this agreement as navigational aids and this agreement shall be interpreted without regard to headings.

Definitions
In this agreement, the following terms have the following meanings

Software Licenses
The User shall ensure that at all times it will have and maintain effective licenses for any software required for the use of the Website and the Tools.

General Conditions

• YES! MARKETING may refuse the User access to areas of YES! Marketing's website on any reasonable grounds, including previous violations of this, or any other agreement between the User and YES! Marketing.
• YES! Marketing may, from time to time, conduct a verification of the details provided by the User from time to time to confirm the User's identity.
• YES! Marketing may use software that checks the location, contents, integrity and identity of any computer or electronic device from which the User is accessing YES! Marketing's website.
• The User shall not have more than one physical copy of the Tools at any time and shall not make or allow to be made any physical copies of the Tools for use by any other person or entity.
• The User shall not store the Tools in any form whatsoever, including any form of electronic storage, for purposes other than viewing the Tools by the User at the time of download of the Tools.
• The User shall not forward or cause to be forwarded the Tools to any other person or storage device in any form whatsoever.
• The User may not allow the Tools to be viewed by any other person except in physical form.
  YES! Marketing reserves the right at any time and from time to time to change the content of the Website.
• YES! Marketing reserves the right at any time and from time to time to change the terms of this agreement.
• The User shall check the conditions of use to ensure that they comply with such conditions of use at all times.
• YES! Marketing shall provide access to the User to the terms and conditions of use on the Website.

Privacy
YES! Marketing Pty Limited will keep information provided by you in accordance with the following terms;

a. YES! Marketing will collect information from the User including, but not limited to, the User's name, email address, physical address and telecommunication device details.

b. YES! Marketing will use the information collected to send the User information about YES! Marketing, its website, tools, and other reasonable information.

c. YES! Marketing will not send the User information about a third party unless requested by the User.

d. YES! Marketing reserves the right to sell the information collected from the User but only to a purchaser of YES! Marketing or to a purchaser of a section of the business directly related to your information.

Disclaimer of Warranties by YES! Marketing Pty Limited
To the maximum extent allowed by any relevant law, YES! Marketing disclaims all warranties including warranties express, implied or created by statute.

YES! Marketing makes no warranties about the fitness for use of any of the Tools or information or anything on the website.

Nothing in the Tools or information or anything on the website will be construed in any way to make any warranty about fitness for use.

YES! Marketing does not warrant that its website or its tools or any other thing are free from viruses. YES! Marketing makes no warranty in relation to the Tools or information offered about correspondence to description of the Tools or information.

Disclaimer of Liability
YES! Marketing shall not be liable for any losses suffered by the User whether incidental, consequential, direct, general or special.

The User will not hold YES! Marketing liable for any loss suffered through use of the website or the Tools. The remedy for YES! Marketing's liability under the terms of this agreement is limited to the amount paid to YES! Marketing by the User under this agreement.
